These Terms of Use ("Terms") are an agreement between you and Hamza Arslan, trading as Şahid Medya ("we", "us") governing your use of the Muslim Plus mobile application (the "App").

By downloading or using the App, you accept these Terms. If you do not accept them, do not use the App.

1. Who may use the App

You may use the App if you are old enough to form a binding contract where you live. If you are under 18, you may use it only with the involvement of a parent or guardian. The App is not directed to children under 13.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use. We keep all rights not expressly granted here.

You may not:

• copy, modify, translate, or create derivative works of the App;
• reverse-engineer, decompile, or disassemble it, or attempt to extract its source code, except to the extent that applicable law expressly permits this despite this restriction;
• rent, lease, sell, sublicense, or redistribute the App;
• remove or obscure any copyright, trademark, or other proprietary notice;
• use automated means to scrape, bulk-download, or systematically extract content from the App or the services behind it;
• interfere with the App's operation, probe or test the security of its systems, or use it to transmit malware;
• use the App in any way that breaks the law or infringes anyone's rights.

3. Religious content — please read

This is the most important section of these Terms.

3.1 Prayer times are calculated estimates

Prayer times shown in the App are computed on your device from astronomical formulas, using your location and the calculation method you select. They are not issued by, verified by, or affiliated with any mosque, religious authority, or state directorate.

Calculated times can differ — sometimes by several minutes, and in some cases more — from the times announced locally, because of:

• the calculation method and juristic (asr) convention you chose;
• high-latitude locations, where astronomical twilight makes fajr and isha undefined for part of the year and any result depends on an approximation rule;
• the accuracy of your device's location, clock, and time zone;
• local conventions, elevation, and horizon obstruction, which no formula accounts for.

Where the App disagrees with your local mosque or religious authority, follow your local authority. The App is a convenience aid for personal planning, not a religious ruling, and must not be treated as an authoritative determination of prayer times.

3.2 The qibla compass depends on your device

The qibla direction is derived from your device's magnetometer and location. Its accuracy depends on hardware that we do not control, and it is easily disturbed by metal objects, magnets, vehicles, electronics, phone cases, buildings, and an uncalibrated sensor. Verify the direction by another means before relying on it, particularly in an unfamiliar place.

3.3 Q&A, verses, and hadiths are general information, not a ruling for you

Q&A ("fatwa") articles are published by us on our website sahidmedya.com and shown in the App. Quranic verses, hadiths, and translations are reproduced from established published sources; gallery artwork is used with permission or under the applicable licence.

This content is provided for general information and personal study only. It:

• is not personal religious advice, and is not a ruling issued to you or about your circumstances;
• answers a question in general terms, without knowledge of your situation, and was not prepared in response to your enquiry;
• may not account for your school of thought, your locality's practice, or the specifics of your situation;
• reflects the scholarly position of its author at the time of writing, which may be one of several recognised positions on the question.

We take reasonable care in preparing and selecting this content, but we do not warrant that it is free from error, complete, or applicable to your circumstances, and we are not responsible for any decision you take in reliance on it. For a matter that actually affects you, consult a qualified scholar or your local religious authority. The App is also not a substitute for medical, legal, financial, or other professional advice.

Where verses, hadiths, translations, or artwork originate from a third party, we are not responsible for the accuracy of that underlying source material or for its continued availability.

4. Location, notifications, and device permissions

The App asks for location, notification, and photo-library permissions. Each is optional and revocable in your device settings, and the App remains usable — with reduced functionality — if you decline.

Notifications are scheduled locally on your device and are not guaranteed to arrive. Operating systems limit background scheduling, and battery-saving modes, "do not disturb" and focus modes, forced-stop, device restarts, clock or time-zone changes, and platform limits on the number of pending notifications can delay, silence, or drop a reminder. On iOS the operating system permits at most 64 pending scheduled notifications; on Android, 500. Do not rely on the App as your only reminder for anything that matters.

5. Availability, changes, and internet access

We may change, suspend, or discontinue the App or any feature at any time, with or without notice. We may also stop supporting older versions and require you to update.

Prayer times, the qibla compass, and your saved settings work offline. Other features — daily content, the gallery, Q&A articles, city search, and place-name lookup — require an internet connection and depend on third-party services that may be slow, unavailable, or withdrawn. Your carrier's data charges are your own.

6. Price

The App is currently provided free of charge. It contains no advertising, no subscriptions, and no in-app purchases. If we introduce paid features in the future, their pricing and terms will be presented to you before you buy anything, and no charge will be made without your explicit consent through the App Store or Google Play.

7. Intellectual property

The App, its design, code, and our branding are owned by us and protected by intellectual property law. Third-party content in the App — Q&A articles, verse and hadith translations, artwork, sounds, and mapping data — remains the property of its respective owners and is used with permission or under the relevant licence. Gallery images are provided for your personal use; you may save and share them as the App allows, but not sell or commercially exploit them.

If you believe content in the App infringes your rights, contact us at the address in section 13 with enough detail to identify the material, and we will investigate and remove it where appropriate.

8. Privacy

Our Privacy Policy explains what the App does with your information. It forms part of these Terms.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that prayer times, qibla directions, calendar dates, or any content in the App are accurate, complete, current, or suitable for your religious observance.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any non-waivable statutory rights you have as a consumer.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the App — including any loss or harm arising from a missed, late, or incorrect prayer time, an incorrect qibla direction, a notification that did not arrive, or reliance on third-party content.

Our total aggregate liability arising out of or relating to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim, or 10 USD.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising from your breach of these Terms, your misuse of the App, or your violation of any law or third-party right.

12. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your licence if you breach these Terms. Sections 3, 7, and 9 through 15 survive termination.

13. Apple App Store — additional terms

These terms apply if you obtained the App from the Apple App Store, and Apple requires them:

• These Terms are between you and us only, not with Apple. We — not Apple — are solely responsible for the App and its content.
• Your licence to use the App is limited to a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Use.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
• Apple is not responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
• If a third party claims the App infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

If you obtained the App from Google Play, the Google Play Terms of Service also apply to your download.

14. Governing law and disputes

These Terms are governed by the laws of Türkiye, without regard to conflict-of-laws rules. The courts of Istanbul Anadolu, Türkiye have jurisdiction over disputes arising from them.

If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may be entitled to bring proceedings in your local courts. Consumers in Türkiye may also apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts.

15. General

• Changes: We may update these Terms. The "Last updated" date will change, and material changes will be notified in the App. Continuing to use the App after an update means you accept the revised Terms.
• Severability: If a provision is found unenforceable, the rest remains in force.
• No waiver: Our failure to enforce a provision is not a waiver of it.
• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
• Assignment: You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
